臺灣地區建築物公共衛生管理制度之研究

The Institution Research of Public Health Management of Building in Taiwan

本文探討中央各主管機關對衛生管理之職掌、法令規範，釐清建管、環保、衛生、教育等單位對建築物衛生管理之重點，借鏡同屬大陸法系且訂有專法之日本及大陸地區，進行比較研究，以研提可行制度建議，供主管建築機關建立建築物「公共衛生」管理制度之參據。結論有以下三點建議：
1. 建議中央主管建築機關得考量以專法研擬建築物公共衛生管理。
2. 建議中央主管建築機關依《建築法》授權進行建築物公共衛生管理。
3. 建議中央主管建築機關研擬建築物「公共衛生檢查」制度或考量併入「公共安全檢查」制度。

This study investigates the duty, decree and regulation of health management taken charge by the Central Competent Authority, and distinguishes the focal points for health management of building administrated by Building Management, Environmental Protection, Hygiene and Education Departments. The Rome Code system applied in Mainland China and Japan areas is compared and reviewed, in order to propose feasible suggestion, which can be used by the Central Competent Authority to create the management system for 'public health' of building in the future. The conclusions of this study include 1. It is suggested that the Central Competent Building Authority should take account the proposal on the public health management of building through specialized legislation. 2. It is suggested that the Central Competent Building Authority should implement the public health management of building under authorization of Building Law. 3. It is suggested that the Central Competent Authority should draft 'Public Health Inspection' system of building or consider for incorporating 'Public Safety Inspection' system.
