法經濟學視國下反壟斷法執行問題探析

On the Enforcement of Anti-monopoly Law in the Perspective of Law and Economics

當前我國反壟斷法公共執行與私人執行均存在執行不足的問題，沒有發揮它應有的影響。從法經濟學的視角看，加強我國反壟斷法行，應注重成本、收益、效率、激勵分析，建立高效的反壟斷法公共執行體制，建立私人執行激勵制度，同時加強兩者的協調配合。

The public and private enforcement of the China's anti-monopoly law is not good, and it does not play its due effect. To strictly enforce the anti-monopoly law, in the perspective of law and economic, the following measures should be taken: Firstly, great attention must be paid to annlysis of cost, benefit, efficiency and stimulation. Secondly, effective public enforcement system and incentive system of private enforcement should be established. Thirdly, the coordination of public and private enforcement should be strengthened.
