我國友壟斷法中的轉嫁抗辯與間接購買者布則構建研究

Research on the Rule of Passing-On Defence and Indirect Purchaser in China's Anti-Monopoly Law

轉嫁抗辯與間接購買者的訴訟地位是世界各國反壟斷損害賠償訴訟中必須面對的棘手問題。美國、加拿大樂及歐盟在該領域公共政策目標的選擇為我國相關規則的建立提供了有益經驗。我國應當平衡反壟法實施的威懾性和實現矯正正義的關係，在承認間接購買者的訴訟地位並且允許嫁抗辯的同時，完善相關實現體和程序規則，袪除所產生的缺陷。

Passing-on denfence and indirect purchaser's standing are thorny issues which must be faced in antitrust damages actions of all the couutries in the world. The choice of the public policy goals in the United States, Canada and the European Union provides useful experience for us. China should admit indirect purchaser's standing and permit passing-on denfence, but at the same time improve the relevant substantive and procedural rules to get rid of the defects, achieving a balance of deterrence and corrective justice in Anti-Monopoly law enforcement process.
