Passing-on denfence and indirect purchaser's standing are thorny issues which must be faced in antitrust damages actions of all the couutries in the world. The choice of the public policy goals in the United States, Canada and the European Union provides useful experience for us. China should admit indirect purchaser's standing and permit passing-on denfence, but at the same time improve the relevant substantive and procedural rules to get rid of the defects, achieving a balance of deterrence and corrective justice in Anti-Monopoly law enforcement process. |
