營建工程體系侵權行為之研究

A Study on Torts in the Construction Context

本研究主要的目的在以營建生命週期的觀點，分析包括建築師或技師、營造廠、地方建管單位等營建 主體當執 其設計、施工、監造以及審照、勘驗過程中因過失（極少 故意）而發生的侵權 。本研究首先探討營建法 體系，接著研究英美法之過失侵權 以及我國的侵權 法體系，並作 者之體系比較。再 探討侵權 法的核心問題－因果關係，其次，侵權與違約既然是民法上 大民事責任，則營建侵權責任與 約責任之交錯自然是 可迴避的議題。於 分析後，當然需要實務研究，因此本文針對營建生命週期中涉及的侵權 ，收集 諸多英美法及我國最高法的院判決與判 ，最後提出本研究的結 與建議。

The purpose of this study is to explore the tortious conducts due to negligent (rarely intentional) act of which the parties may incur during the process from design, construction to oversee the project and the submittal review, site inspection undertaken by the architect, engineer, contractor and local authority respectively under the life-cycle viewpoint of construction project. It starts with focusing on the legal framework of construction law. The theory of negligent tort in common law and the tort law system of our country then are explored and comparison is made as well. The core issue on tort, i.e. causation theory is to be studied in the next. Furthermore, the issue on the cross-action between duty of tort and that of contract seems to be inevitable since tort and breach of contract both are related to civil duties. After the theory analyzed, empirical research is necessary. Therefore, related torts involved in the life-cycle of construction, many trials and judgments of the Anglo-American law and the Supreme Court of Taiwan are collected. Finally, the conclusions and suggestions are presented after the analysis of this study.
