This paper tries to investigate the risks of buying superficies right-based houses for consumers and takes Zone T-9 development project in Taipei city as a case study. From the literature review we summarize the related problems and select interviewees from scholars and specialists. We find the main risks are as follows: the determinate contract, the mortgaged objective, the leasing time period, the taxation, the encumbrance without priority. Finally, this paper suggests that as consumers' rights and interests are damaged, they can execute the right of withdrawal after consumer lending and use arbitration law to protect their rights and interests. However, as consumers buy these kinds of commodities, they still should consider carefully the above risks. |
