淺介日本刑法學中的原因自由行為理論

On Theories of Action Libera in Causa in Japan

本文是關於日本刑法學上原因自由行為理論的介紹論文。本文主要的內容可分做二部分，第一部分介紹原因自由行為的相關理論，包含主張構成要件模式的見解、主張例外模式的見解，以及主張兩種模式併用的見解，以及主要的日本最高裁判所實務事例。第二部分則介紹原因自由行為的周邊問題，亦即行為人著手實行開始後才喪失責任能力或進入限制責任能力狀態的情形的相關學說與理論。透過這樣的介紹，應可相當程度理解日本刑法學上關於原因自由行為的討論中，責任能力與行為同時存在原則、實行行為、未遂犯的著手實行等概念的交錯情形。

This Essay has two parts. In the first part, this Essay surveys the theories and judicial practice concerning action libera in causa in Japan. In the second part, this Essay surveys the theories and judicial practice concerning the situation of one losing his criminal responsibility after he attempts to realize. Through this essays, the theoretical structure of theories concerning action libera in causa in Japan can beclarified.
