Investigating “Offenses Chargeable Only upon Complaint”

本文在一一檢析現行刑法規定之告訴乃論之罪，在刑法與刑事訴訟法交互運作下所產生之爭議，並逐一對告訴乃論之罪提出立法或修法方向之建議，其中亦對某些告訴乃論之罪除罪化的議題也有著墨，並提出個人看法。

This paper first investigates “offenses chargeable only upon complaint” regulated in the current criminal law one by one, probes the controversial issues arising from the interaction of criminal law and criminal procedure law, and then proposes suggestions for legislating or revising the articles regarding “offenses chargeable only upon complaint” one by one. Moreover, this paper elaborates on issues about decriminalizing some of “offenses chargeable only upon complaint” and provides the researcher’s personal viewpoints about them.
