Article 21 of ''Law on the Applicable Laws of Foreign-Related Civil Relations'' stipulates the conditions for foreign-related marriage. It is neither an administrative norm for the conclusion of marriage nor a conflicting norm about the influence of marriage, but a conflicting norm about the validity of marriage. The judicial application of Article 21 may result in invalidating a marriage that has been legally concluded in another country. When examining the legislative practices of various countries, the usual practice is to separately stipulate the conflict regulations for the conclusion of marriage and the validity of marriage. Marriage validity norms take ''in favor of marriage'' as the primary principle and use the place where the marriage is concluded as the main connecting point. |
