臺灣人民的食品安全相關基本權研究

Research on the Taiwan People’s Basic Rights of Food Safety

食品安全是臺灣近幾年來法學研究的熱門議題，從監管制度或從法律保障層面探討的文章較多，但對於從人民的食品安全基本權角度保障的研究卻付之闕如。本文從憲法保障臺灣人民食品安全相關的基本權展開，論述憲法對於臺灣人民的基本權保障。雖然有些基本權，憲法並無明文規定，但則透過大法官的相關解釋或是憲法保障人民基本權的意旨，來達到保障人民其他食品安全的基本權利。

Since food safety is a hot topic in Taiwan in recent years, there are many articles about that. However, most of them are from the regulatory system or from the legal protection level, but the research on the protection of the basic rights of people’s food safety has been paid. This article starts from the constitutional guarantee of the basic rights related to food safety of the Taiwan people and discusses the constitutional guarantee of the basic rights of the Taiwan people. Although there are some basic rights, the Constitution does not expressly stipulate, but the basic rights to protect people’s other food safety are achieved through the relevant interpretation of the justices or the constitutional guarantee of the people’s basic rights.
