國際商事專家委員會運行機制的創新、困境及紓解

Innovation, Dilemma and Relief of the Operation Mechanism of International Commercial Expert Committee

國際商事專家委員會是“一帶一路”背景下中國司法領域的突破性創新，彌補了國際商事法庭單純由中國法官審判的不足，為“一站式”爭議解決機制提供了支持與保障。但由於《國際商事專家委員會工作規則（試行）》內容較為原則，專家委員依據該規則進行調解、提供域外法律查明和國際商事法庭發展意見時可能會陷入是否合規的困境。為紓解困境，不僅須明確該委員會的性質是法院系統提供專業法律服務的輔助性機構，而且，還應在細化具體程序的基礎上，探索專家委員參與庭審活動的可行性，增加專家委員的聘任程序和監督程序，保證專家委員的獨立性、公正性和專業性，在打造特色化的國際商事爭議解決機制過程中，為中國參與全球治理提供法治保障。

The International Commercial Expert Committee is a breakthrough innovation in China’s judicial field under the background of“the Belt and Road”. It helps to make up for the inadequacy of International Commercial Courts trials being conducted solely by Chinese Judges, to provide support and guarantee for the“one-stop”dispute resolution mechanism, and to strengthen the exchange and cooperation on international commercial dispute settlement. Due to the rather principled content of the Working Rules of the International Commercial Expert Committee of the Supreme People’s Court (For Trial Implementation), the expert members may fall into the dilemma of compliance when performing mediation, providing external legal identification and opinions on the development of international commercial courts. To alleviate the dilemma, it is necessary to clarify the nature of the committee to be professional legal services for the court system, and on the basis of refining the specific procedures for expert members, to explore the feasibility of expert committee to participate in trial activities, to stipulate the procedural rules of hiring and supervising expert members, to ensure the independence, impartiality and professionalism of the experts. All in all, in the process of creating characteristic international commercial dispute resolution mechanism, we should spare no efforts to provide legal guarantee for China’s participation in global governance.
