This article aims to discuss the due process of the designation of monuments, and take the recent practical court judgment as an example to deeply discuss the relevant legal sources, procedural flow, procedural elements, protection of rights and interests, openness and transparency, environmental impact assessment requirements, and social participation and democratic participation in the process of designation of monuments and other topics, and analyze and discuss the impact and inspiration of practical judgments on the monument designation procedure, and finally put forward suggestions and improvement directions for the monument designation procedure, hoping to be helpful to the monument protection cause. This article aims to clarify the legal sources and procedural elements of various issues in the monument designation procedure, and to explore the impact and enlightenment of recent practical judgments on the monument designation procedure, and to put forward specific suggestions and improvement directions. The research scope of this paper is limited to the Taiwan area, and the future research direction can be carried out in the following two directions: to discuss other related issues in the process of monument designation, such as expenditure, management and supervision, etc.; on the other hand, from the perspective of international comparison From this perspective, discuss the practices and achievements of different countries in the protection of historical sites, so as to serve as a reference for the development of historical site protection in Taiwan. |
