Due to defects of algebraic algorithm provisions (algebraic provisions) in the private law system, some directive cases fail to provide clear algorithms of the judgments, that is, black boxes of algebraic algorithm in the private law system lead to algorithm defects in the judgments. Traditional private law is deeply influenced by ancient Greek geometry, so it alienates the algebraic algorithm and ignores the corresponding algebraic provisions. The prosperity of machine algorithm in legal artificial intelligence does not alleviate black boxes of algebraic algorithm in private law, but overlays the new algorithm black box on the traditional black box. Algebraic provisions are the legal norms specified algebraic computation in private law system, which are the quantitative dimensions and an indispensable part of private law system, and they become more and more important with the rise of algorithm in epistemology. Private law system should change the tradition of alienation of algebraic algorithm, improve its algebraic provisions, apply them as the basis for civil judgments, and combine geometric provisions to guide and test legal artificial intelligence, so as to limit algorithm defects in the judgments. |
