Marine Biodiversity of Areas beyond National Jurisdiction (BBNJ) identifies the major issues at stake in the BBNJ negotiations and examines the conservation and sustainable use of marine biological diversity of areas beyond national jurisdiction. This paper intended analysis on access and benefit sharing of marine genetic resources; environmental impact assessments as well as capacity building and transfer of technology. Cross-cutting themes including the potential impact on existing legal frameworks and instruments are also explored. This article provides an analysis of the final draft text, focusing on the general provisions, institutional arrangements and substantive provisions relating to the elements of the“package deal”(Parts I-VI). The analysis focuses on identifying key areas of progress or controversy regarding the negotiations and identifies some possible options for strengthening the text. Part 2 examines the general provisions and institutional arrangements, while Part 3 explores the textual options on which countries are reaching consensus, as well as any outstanding issues related to the package deal elements. Part 4 provides some concluding remarks. |
