International Covenant on Economic, Social and Cultural Rights confronted several challenges including whether to be adopted as a treaty, different rights norms, unique Committee on Economic, Social and Cultural Rights and belated individual communication system. Two of them are still remain: different rights norms and unique Committee on Economic, Social and Cultural Rights. Therefore, what should be reviewed is whether a unique Committee can offer breakthroughs of different rights norms by examining individual communications. However, results of examination of individual communications show some characters including not a long time, not many cases, not many defendant states, not much substantial views, not broad ambit. The Committee applied interim measure when it was necessary, but states did not comply with. Individual communications concerned four rights, i.e., social security, health, family and housing, which are only small portion of the Covenant. The Committee set high standards, and proposed individual and general recommendations to offer remedies and expect better protections. It is however regretful that states did not always implement recommendations. |
