The purpose of this article is to analyze how the Area-Based Management Tools provided in the legally binding agreement under the future United Nations Convention on the Law of the Sea on the Conservation and Sustainable Use of Marine Biological Diversity of Areas beyond National Jurisdiction (BBNJ) would affect the littoral state’s maritime jurisdiction and the possible harmonizing solutions. Based on the observation of the state practices of the Convention for the Protection of the Marine Environment of the North-East Atlantic, the author argues that the principles of adjacency, connectivity, compatibility and due regard respectively would be the legal bases of the harmonization between the future BBNJ agreement and the maritime jurisdiction of littoral states. |
