臺灣食品安全法制若干法律問題研究

Research on Several Legal Issues of Food Safety in Taiwan

食品安全是臺灣近年來法學研究的熱門議題，現在臺灣的食品安全監管制度在運作上，經過了這些年的實踐也存在著諸多的法律問題。本文列舉了幾個與臺灣人民最為切身利益的法律問題來探討與分析，諸如：食品安全檢驗防線、消費者的舉證責任、犯罪者的不法利得和食品犯罪上的立法漏洞。以期立法院未來能夠將之完善，使臺灣人民在食品安全的保障上更為全面。

Food safety is ahot issue in Taiwan recent years, now the operation of food safety supervision system has faced various legal problems after years of practice in Taiwan. This article lists some legal problems that Taiwanese people care the most to discover and analyze, such as: the perimeter of food safety inspection, the responsibility of consumer to offer evidence, the illegal profit of delinquent and legislative loophole of food crimes, in order to increase food safety insurance for Taiwanese people, and make the whole system perfect.
