由現行菸害防制法吸菸場所限制範圍劃分所衍生之爭議及困境出發，探討我國菸害防制法因規範方式所衍伸之實務執法問題，進一步分析國外立法例及2017年由行政院所提出之菸害防制法修正草案，希冀找出修正草案中得以解決之實務困境，以及尚待解決之問題，最後提出修法之建議。

Beginning with Analyzing the scope of Places Where Tobacco Use Are Restricted in the Tobacco Hazards Prevention Act to dig the practical controversy and dilemma. To analyze foreign legislation and the draft amendment Tobacco Hazards Prevention Act (2017), in order to find the solution and insufficient of the draft amendment. In the conclusion, try to make some suggestions for the draft amendment.
