A person’s life and health are the most important basis for individual survival and freedom. This study discussed the meaning of health at the beginning. According to the World Health Organization (WHO) definition of health as a state of complete physical, mental and social well-being and not merely the absence of disease or infirmity. And Universal Declaration of Human Rights Article 25, “Everyone has the right to a standard of living adequate for the health and well-being of himself and of his family, including food, clothing, housing and medical care and necessary social services, and the right to security in the event of unemployment, sickness, disability, widowhood, old age or other lack of livelihood in circumstances beyond his control”. As mentioned in Article 12(d) of the International Covenant on Economic, “Social and Cultural Rights (ICESCR) of the United Nations. The steps to betaken by the States Parties to the present Covenant to achieve the full realization of this right shall include those necessary for: … (d) The creation of conditions which would assure to all medical service and medical attention in the event of sickness”. From the constitutional point of view, the meaning of the right to health includes the right to freedom and the right to benefit. And the state’s obligation to protect national health. This article attempts to build a comprehensive legal framework for right to health. |
