本文主要採用文件分析法,彙整與教育部校長領導卓越獎評選作業與出席費有關的特定法規,從「職務」、「待遇」與「聘約」觀點,探討教師代表支領出席費的適法性。為周諮博採、集思廣益,主管教育行政機關辦理評選作業,屢以「委員會」運作,教育部校長領導卓越獎評選,恰一適例。基於「代表性」設想,「教師代表」輒在列,中央與地方運作皆然。然社團法人教師會在地方政府邀約後推薦自身成員以充任評選委員前提之下,該受薦以出席的教師代表得否適法(令)地支領出席費一事,容生疑義。本文主張受聘擔任校長領導卓越獎評選會議委員,顯非「教師代表」或是「任一教師」法定或聘約上的職責,該等人員以「事假」出席評選會議,主辦機關允以「外聘委員」相待,乃存有支領出席費的適法令空間。

This study tried to use ''Document Analysis'' and aggregate the related regulations concerning ''the Selecting Process of Principal Leadership Excellence Award'' and ''Conference Attendance Fees'', discussed the legality of teacher representatives' receiving conference attendance fees, from the viewpoints of ''Position'' , ''Compensation'' and ''Teachers' Appointment Contracts''. In order to adopt opinions of all parties, the educational competent authority may carry out selecting activities in the form of a committee. Principal leadership excellence award, Ministry of Education is an appropriate example exactly. Based on ''representatives'', teacher representatives are always invited to attend meetings, whether it is a central case or a local case. Teacher associations will recommend their members to serve as committee judges. Can they charge fees for attendance? This is a topic worth discussing. According to this study, the appointment and membership of the committee has nothing to do with the teachers' statutory duties or the content of the appointment contract. They take vacations to attend meetings, and the competent authorities consider them as external members. In this way, they can legally collect conference attendance fees.
