法學教室－－認識法學：淺談民、刑法

The class of law - to approach the study of jurisprudence

法律領域浩瀚無窮，有其非常人所能理解者，法學之所以成為一專門學術領域，自有其深奧的理論與各層面相連結之學理，必也須費長時期之歲月埋首書經始能知之。法學教室於此僅提供些學習法學最基礎之概念，以協助對法學有與趣的同學增強法學的思考邏輯。 第一部份前言介紹法學之學習由淺而難，通識教育在培養全人教育，全人教育之宗旨在形成以個人為基礎之人性尊嚴，「知之者，必為尊。」其理在此。第二部份介紹法學教室之功能在於週知，而非在於專門，從原始社會到法治社會之演進，從無法律理念之自然生活到以法律制度維持制定法之社會生活，這其間說明了法的必要性。第二部份介紹「民法」之意義及實例分析，以增強同學對法效力之因果關係，而引起爭端糾紛時如何的以司法制度加以救濟解決也是現代人必須學習的。第四部份介「刑法」，罪與罰是法治社會最基本的守則，「犯了罪等待處罰」是法治社會應有的生活態度，而執行此種「應有的生活態度」，就得依賴國家發動刑罰權介入始能維持秩序。第五部份介紹民、刑法是保障人權之一部份，其實保障人權的法律，還有更多的法體系存在，有更多的法律制度用來保障人權法益的，當吾人受國家或個人侵害時，就必須用不同的法律體系加次排除與救濟。第六部份介紹法學教育的重要性，健全的公民社會需要公民皆有法學的邏輯思考能力，而以此種思考能力建設更現代化的社會。 法律是現代人必備的常識，法學更是一門專門的學問，對一般而言，法律是艱澀難懂的，尤其是法律的專用名詞，譬如：實際損害賠償、懲罰性損害賠償、權利侵害、法律不溯既往原則，法律的正當程序等等，非專攻學習研究法律者實不易了解。但法律又是生活上不可或缺學問，因此學習者由淺入難的學習過程是必要的，在本論文中介紹的民、刑法，更是生活在社會上不可或缺的法律常識，為提供學習者方便學習，筆者提供民、刑案情分析，以輔助加強理解法律能力。

A common knowledge about law if requiste for the morden generation practice professional law-relevant problems, it's incomprehensible to people who have no knowledge about legislation, specially, the use of words in law, for example : "punitive damages" , "trespass" , "ex fast facto law" , "due process of law", he can't take easy to understand what's the meaning of these words, but still a requiste sense of living needs. Basic all, to comprehened legislation contents from its simple to its difficulty, is a must learning of process, here, I want to introduction the civil law and the criminal law. The civil law contains the civil rights and duties, in relation to the rights and duties of person in contract, tort etc. But the criminal law is a punitive law to the people who has been convicted of a violation of a criminal laws, then, to suit the punishment to the crime. This subject provides as a tool of study is assisting all its learning about the legislation.
