我國民法典對類法典化立法的規則創新

我國《民法典》的誕生，標誌著我國民法發展歷史中類法典化階段的結束，法典化階段的開始。《民法典》的規則體系是在我國類法典化的鬆散民法的基礎上進行編纂和創新完成的，改變了類法典化鬆散民法的規則衝突、規則不足和規則錯誤的狀況，實現了民法規則的體系化、完善化。《民法典》規則的創新表現在四個方面：一是補充欠缺的傳統規則進行的規則創新，二是因應時代進步挑戰進行的規則創新，三是糾正以往規定的錯誤規則進行的創新，四是補充和完善原有規則的立法不足和缺陷進行的創新。《民法典》對民法規則的創新，使我國《民法典》規則處在時代發展的前沿，反映了新時代對民法規則的需求。對於《民法典》尚存在的不足，應當進一步總結實踐經驗、加強理論研究，及時進行司法解釋，適時進行修訂，使《民法典》在我國社會生活和維護民事主體民事權益中發揮更大的作用。

The birth of China’s Civil Code marks the end of quasi-codification and the beginning of codification in the history of development of civil law in China. The rule system of Civil Code is compiled and innovated on the basis of the patchwork civil law legislation formed during the period of quasi-codification, which changes the situation of the conflict of rules, the insufficient rules and the wrong rules formed during the period of quasi-codification, realizing the systematization and perfection of the rules of civil law. The innovation of Civil Code rules is embodied in four aspects: first, the innovation of rules to supplement the lack of traditional rules; second, the innovation of rules in response to the challenges of the times; third, the innovation of correcting the wrong rules stipulated in the past; and fourth, the innovation of supplementing and perfecting legal deficiencies and shortcomings of the original rules. The innovation of civil law rules in the Civil Code makes our Civil Code rules at the forefront of the development of the times, and reflects the demand for civil law rules in the new era. As for the shortcomings that still exist in the Civil Code, we should further summarize practical experience, strengthen theoretical research, make timely judicial interpretation, and revise it timely so that the Civil Code can play agreater role in the social life of our country and in safeguarding the civil rights and interests of citizens.
