同性伴侶關係戶政註記之效力及侷限

The Validity and Limitations of Same-Sex Couple Relationship Household Registration

2015年是臺灣同性戀者的重要的一年，因為不論是行政機關或司法實務，都已經正視到同性戀者法律上的權益。其中在行政機關上，包括臺北市、臺中市及高雄市等三個直轄市，已經開放各區戶政事務所辦理同性伴侶關係註記，對於同性伴侶身分認定上，提供較為明確的依據；在司法實務上，就前述的身分登記問題，同志也勇於突破，目前已有個案聲請大法官會議解釋中。面對此類的問題將不斷出現，勢必衝擊我原本民法及戶政法等登記實務，主管機關內政部及法務部等應及早面對及提出因應作為，而不能只是跟著個案事件或滿足部分政客媚俗之作，應擬定相關配套來妥善規畫。揆諸先進國家立法例，有諸多可以借鏡之處。有鑑於此，本研究謹先介述該戶政登記的背景事實，並引用外國法例比較，提出法制面及行政管理層面等角度的分析，試圖釐清、擘劃及建議政府未來將可以進行的策略及處理方法，期能精進對應作為，有效保障同性伴侶之權益。

2015 was an important year in Taiwan for homosexuals, because either the administrative or judicial practice, already notice the rights and interests of same-sex couples. There are three municipalities of Taipei, Taichung and Kaohsiung city government, have provide domestic partners household registration at district household registration office, that could recognize the relationship of the same-sex couples identity. In judicial practice, there are some domestic partners registration case is under petition for an interpretation of the Constitution. The similar problems will emerge in the future, those will impact the civil law and registration practices. The Ministry of Interior and the Ministry of Justice and other authorities should face the problems and response in proper planning, not just deal the case by case. There are many good regulations of advanced countries in the world, which Taiwan government can learn from and imitate. In this study, we introduce the background facts that the household registration, and cited foreign legislation for comparison, provide the legal and administrative angles of analysis, trying to clarify, map out the policies, and suggest the strategies that government can be able to carry out, so that can effectively protect the rights and interests of same-sex couples in modern society.
