The main theme of this paper is to discuss the provisions of German Civil Code on medical malpractice with a comparative study of Taiwan law and court decisions. It is to illuminate the features of German law on this respect and to provide meaningful insights for the revision of Taiwan Civil Code in the future. The revision of German Civil Code in 2013 added a new contract law of medicine, stipulating the issues such as the duties of medical provider and patients, the standard of care, the presumed negligence of medical provider, cooperative duty of a patient, the duty of disclosure of medical provider, informed consent rule, the duty of providing medical records, and the presumption of causation, etc. Such provisions provide accurate concepts of medical law and insightful legal resolution to medical malpractice problems, which can make contributions to the revision of Taiwan Civil Code in the future. |
