This study is an international legal analysis of the labor rights of employed attending physicians. The scope was restricted to the international comparison of working time, right to unionize, right to collective bargaining and right to strike. For the issue of working time, only the UK provides working time protection in compliance with the EU directive, whereas both Taiwan and the US have precluded physicians from working time protection. However, attending physicians in all three countries are entitled to the aforementioned three labor rights albeit there are different restrictions on labor unions. Although physicians can strike, there are ethical concerns. If physicians really have to strike, they need to provide urgent and emergency care so as to mitigate the impact on patient rights. |
