照顧與被照顧者間的衡平：我國家事勞動立法及適法建議

The Balancing Caregivers and Cared: Legislation of Domestic Workers in Taiwan

本研究整理國際勞工組織家事勞動規範及我國立法，分析制度選擇及其修法方向，並佐以焦點座談、說明會及訪談資料，進一步協助我國建立適合的家事勞動法制。研究發現，我國家事勞動法制係在長期照顧服務需求引導下所建立起一套強調彈性，且偏向補充性的政策及相關法規範。首先，在政策層面，家事勞動的內涵係由我國社會福利體系所主導及定義，勞工行政體系主要的工作在於配合建立長期照顧服務體系的需求。其次，在補充性原則下外國人從業者排除適用勞動法，因而回歸勞雇雙方契約自由原則，採用契約方式約定工資、工時及休假等勞動條件。現行法制因國籍而產生差別待遇，而差異又是來自「給付行政」與「許可制」而生的根本問題。基於此，研究建議「支持高齡化社會下的工作家庭，以喘息服務避免被照顧者家屬退出勞動市場」為立法核心，導向機構僱用，並針對數個共識度高的面向進行立法，以衡平概念替代勞動保障，並以各種政策創新整合外籍看護工提供服務。

This study intends to extend the protection of the working conditions of the domestic workers. We analyzes the choice of the regulation of Taiwan government and the direction of its revision, and assist Taiwan to establish a suitable domestic worker legal system. The study proposes that ''supporting working families in an aging society, assisting to avoid the family members of the caregivers from withdrawing from the labor market'' is the core of legislation, enacting legislation for a number of highly agreed-oriented, replacing the labor security with the concept of equity, and adopting various policies.
