「情節輕微」於刑事法中之判準——從食品衛生管理法第49條出發

“Minor Plot” of Article 49 of Act Governing Food Sanitation in 2014 Is Worthy for Us to Take as a Reference to Explain “Minor Plot” of Paragraph 1 of Article 185 of Criminal Code in 1999

2014年方始誕生於食品衛生管理法（下稱食安法）第49條的「情節輕微」條款，在前兩年的食安風暴中，隨著情節重大條款，也一併出現在附屬刑法中，反觀普通刑法分則中首見「情節輕微」之刑罰減輕條款，為1999年規定在刑法第185條之1中。不過刑法中的情節輕微由於是航空刑法的一環，因此學說與實務幾乎很少有對此加以註釋。本文將自食品衛生管理法出發，觀察情節輕微條款的運作情形，並以此為立基，進而找出對於此種價值輕微條款的一般性詮釋方向。本文除了整理現有對於案件輕微者在刑事法的解決方法外，也表述了在理論上如「可罰性違法性」、「輕微性原則」的努力；更介紹了德國法上的情節輕微條款、價值輕微條款與中國大陸刑法第13條等的內容。除了希望能藉此歸納出情節輕微條款為減輕刑罰裁量事由的定性外，也試著由此提出未來可能依循的判斷主軸：即依據各罪的保護法益，與行為手段的反社會性，抽離出不法與罪責內涵相較一般情形情節輕微者，給予合宜的刑罰。更期待未來可以在實務上適用的判斷標準，並進而作出更妥當的裁判，除可促進刑事法學的釋義外，對於司法實務的裁判也將有助益。

This article will base on the standpoint of Act Governing Food Sanitation, observing the operation of Minor-plot clause and finding out the way to explain it. Besides, it will also discuss the efforts on the theory like Punishable illegality and Minor principle. In addition, the content includes the clause of Minor plot and Minor value in German law, Article 13 of Criminal Code in China, etc. We try to propose the judgment that could be followed in the future. That is, distinguishing misdemeanor out from the crime and giving them proper penalty according to Legal Interests and antisocial behavior.
