Jade of Other Mountains: Professor Jérôme Bourgon and His Studies on Chinese Legal History

鞏濤是當今法國漢學界中研究中國法律歷史的領軍人物，其研究成果深受專業人士稱讚，在中國大陸及歐美漢學界具有廣泛影響。他此前以英文、法文發表的法史學術論文，即將在中國大陸結集出版。本文結合其近二十餘年所從事的學術研究計畫，梳理其在中國法律史研究領域的學術成果，並剖析這部即將出版論文集錄各篇文章的要點，試圖較全面地介紹其學術旨趣，並特別分析其對中國傳統法律性質及異域法律形象的研究，希望有助海內外法史學界進一步研究相關課題。 Professor Jérôme Bourgon is the leading figure in the study of Chinese legal history in French Sinology. His research has been highly praised by Professors Marianne Bastid-Bruguière and Pierre-Étienne Will, and his work has had an extensive influence in mainland China and in European and American Sinology. His academic papers on legal history, riginally published in English and French, have been translated and will soon be published in mainland China. This article brings together the research plans of Jérôme Bourgon over twenty years, systematically sorts out his academic achievements in the field of Chinese legal history research, and gives a summary review of the contents of each article. In so doing, it attempts to introduce this outstanding body of scholarship to Chinese academic circles in a more comprehensive fashion, and to interpret Jérôme Bourgon's wonderful research on the nature of Chinese traditional law and its exotic image, in hopes that it will help scholars of legal history both in China and overseas deepen their research.
