To cope with the need of environmental protection, the civil code needs to adjust itself to a certain extent. However, the civil code should stick to its inherent characteristics and limit its “greenization”. Beyond the civil code, we need to rely on environmental laws and regulations to provide more comprehensive protection. China's environmental laws and regulations have experienced tremendous development, but there is still a lack of system construction with many adverse effects on the rule of law. So we need to systematize them. For China, codification is the best way to enhance the political influence and give full force to the actual effect of environmental laws and regulations. The codification of environmental law is different from the civil code, however. Due to its variability and immaturity, it should be appropriate. The civil code and the environmental code should realize the “common governance” of the ecological environment: on the one hand, the civil code can be properly integrated into the concept of environmental protection to achieve the environmental protection function; on the other hand, the environmental code can achieve the seamless connection with the civil code through the setting of the relevant rules. |
