Indigenous Consultation and Consent Rights in Canada

本文旨在探討加拿大原住民族諮商同意機制，作為後續台灣實踐時的經驗參考。基本上，從加拿大的經驗來看，原住民族諮商同意權仍然是一項充滿爭議的概念。因此，如何建立政府與原住民族間之信任關係，絕對是完備諮商同意機制的首要前提。再者，原住民族諮商同意權要如何被定義及具體落實，應賦權原住民族對於諮商同意權的能動性闡釋，據以保障原住民族有效的決策參與，並確保原住民族自主，事先與知情同意的機制平台。 This article explores the Indigenous consultation and consent mechanism in Canada as a reference for Taiwan's institutional design. From the experience of Canada, the Indigenous consultation and consent rights are still a controversial concept. Therefore, how to establish the trust relationship between the government and the indigenous is the prerequisite for completing the mechanism. Furthermore, the mobilized interpretations of the indigenous consultation and consent rights should be given to ensure the participation of the indigenous peoples in decision-making.
