設區的市增強地方立法特色研究

The Study on Enhancing the Characteristics of the Legislation Made by Municipalities

有特色是地方立法始終保持活力的重要體現，也是衡量地方立法質量的重要標準。在立法實踐中，地方立法的特色具體體現為:在立法切入點方面表現為獨到的地方立法空間，在法規形式方面體現為適當的立法體例，在規范內容方面表現為創新的制度設計，立法手法表現為獨特的立法方法，立法時機方面表現為鮮明的時代感。2015年以來，包括福建省所屬在內各設區的市的立法工作已全面展開，但在具體實踐中卻暴露出立法質量不高的問題，突出表現在缺乏地方特色。經驗表明，設區的市立法的特色既可以通過注重契合實際情況、注重秉持問題導向、注重進行精細立法和善於開展先行性立法等路徑來實現，又可以通過開展區域協作立法來實現。與此同時，強調設區的市立法要增強地方特色，還必須注意避免將立法的地方特色片面理解為''地方唯一''的錯誤思想，努力做到''人無我有，人有我優''。

Characteristic is an important manifestation of the vitality of local legislation,is also an important criterion to measure the quality of the legislation made by municipalities.In the legislative practice,the features of local legislation are as following:Firstly,the breakthrough point of legislation,it shows unique local legislative space.Secondly,in the form of legislation,it embodies the appropriate legislative style;Thirdly,in terms of normative content for innovative institutional design.Fourthly,the legislative method shows a unique legislative method.Fifthly,the timing of legislation shows a distinct sense of the times.Since 2015,the legislative work in cities,including Fujian,has been fully developed,but in practice it has exposed the problem of low quality of legislation,which is mainly manifested in the lack of local characteristics.Experience shows that the characteristics of the city legislature can fit in with the actual situation,focus on the problem oriented,pay attention to uphold the fine legislation and legislation to carry out a good path to realize,and can be achieved through the development of regional collaboration legislation.At the same time,it emphasizes that local legislation should be strengthened in the legislation of cities,and the local characteristics of legislation should be avoided to be understood as the only,and efforts should be made to achieve''When others all have no,we have;When people have,we are superior''.
