It is not difficult to see the ideals of the separation, balance, and check of power in our current Constitution and its Amendments. There are, however, controversies regarding the identification and the limitation of administrative power and the relationship between administration and legislature. This article exemplifies the theory of the separation of power, and proves the meaning, characteristic and identification of the administrative power in our Constitution. The study demonstrates some significant cases interpreted by the Lord Chancellor’s Meeting. These theoretical investigations aim to clarify and solve these crucial constitutional problems. |
