A Discussion on Perfection Path of Local Ecological Redline Legislation

生態紅線地方立法圍繞立法目的展開，生態紅線制度產生和發展順應生態文明建設的需求，其立法目的可以歸結為生態文明建設和可持續發展。作為我國原創的國土空間管控制度，生態紅線地方立法的制度設置旨在實現國土空間管控和優化國土空間。生態紅線地方立法的制度目標是生態安全和生態系統平衡。生態紅線的立法和發展軌跡能夠恰當地論證生態紅線地方立法的重要性，生態紅線中央立法為地方立法提供制度框架和立法空間。明確生態紅線地方立法的目的、制度特性、制度目的和立法軌跡，以此為基礎完善生態紅線地方立法的路徑是：在實體層面完善生態紅線地方立法體系，包括自然保護區地方立法以及生態紅線配套立法；在程式層面，完善生態紅線劃定和管理法律程式以及公眾參與程式。完善生態紅線地方立法的目標是生態紅線更好地實施和“落地”。
