地方立法後評估框架性體系探析

地方立法後評估是提升地方立法品質和完善立法工作流程的有效途徑。目前，我國地方立法後評估實踐已經取得長足發展，評估範圍及重視度明顯提升，不僅為相關法規完善提供了可靠依據，推動了公民有序參與立法工作和立法後評估制度建設，也為立法評估研究提供了諸多有益啟示。基於地方立法後評估實踐回顧，從“為什麼評估”“誰來評估”“評估什麼”“如何評估”等立法後評估的基本問題出發，圍繞評估目的、評估主體、評估物件與內容、評估組織、評估方式等多個方面展開深入探討和分析，提出更加符合地方實際的立法後評估框架性體系。

The after-evaluation of local legislation is an effective way to improve the quality of local legislation and improve the legislative process. At present, our local legislative evaluation practice has made considerable development, the scope of evaluation and the degree of attention improved significantly, not only provides a reliable basis for the perfection of relevant regulations, and promote the construction of evaluation system as well as citizens’ orderly participation in the legislative work. The Review also provides many useful suggestions for related research and based on Evaluation of local legislation, from “why evaluate” and “who evaluate”, “what evaluated”, “how to evaluate”, the basic problems of legislation after-evaluation to focus on evaluation purpose, evaluation subject, evaluation object and content, evaluation organization and evaluation way, through in-depth discussion and analysis, framework system of evaluation is more in line with the actual local legislation.
