農村集體建設用地使用權流轉的地方立法問題研究──以《廣東省集體建設用地使用權流轉管理辦法》為例

Research on Local Legislation of the Circulation of the Right to Use Rural Collective Construction Land-Taking Measures for the Administration of the Transfer of the Right to Use Collective Construction Land in Guangdong Province as an Example

農村集體建設用地使用權流轉是我國農村土地改革的重要內容，也是保障農民基本權利尤其是經濟權利的主要方式。廣東省早在2005年就頒行了《廣東省集體建設用地使用權流轉管理辦法》，擴大了農村集體建設用地使用權的主體，確立了農村集體建設用地使用權流轉的範圍和方式，細化了農村集體建設用地使用權流轉的條件和程序，為中央立法提供了有益的經驗。但是在農村土地改革迅速發展的今天，這一流轉管理辦法在相關法律概念、流轉的方式以及宅基地使用權流轉等方面仍需進一步明確和完善。

The transfer of the right to use rural collective construction land is an important part of the rural land reform in China, and also an important way to protect the basic rights especially the economic rights of farmers. In 2005, Guangdong Province issued the Measures for the Administration of the Transfer of the Right to Use Collective Construction Land in Guangdong Province, which expanded the main body of the right of use of rural collective construction land, established the scope and the way of circulation of rural collective construction land use rights, refined the conditions and procedures for the circulation of rural collective construction land usage rights. All this provided useful experience for the central legislation. However, with the rapid development of rural land reform, the Measures still needs to be further clarified and improved in relevant legal concepts, ways of circulation, and the transfer of usage rights of Homestead Land.
