地方立法立項程序的建構

Construction of the Project Approval Procedure of Local Legislation

作為提高地方立法質量的重要舉措，地方立法立項在我國地方立法實踐中已實際運行，並發揮著明顯的社會功效。但是，我國地方立法立項機制法治化程度極低，其程序設置亦顯粗陋。地方立法立項程序的法治化建構是地方立法制度完善的客觀訴求。公正、理性的地方立法立項程序應該包括立法建議項目的徵集、立法建議項目的初步審查與整理、地方立法立項草案建議稿的擬定、審議與公佈，以及地方立法立項項目的審議通過、公佈與調整等具體的程序性階段。每一個具體的程序性階段也需要精細化建構。

As an important measure to improve the quality of local legislation, the project approval procedure has been practically operated in the practice of China. However, rules and procedures for regulating the legislative project approval are not well developed and need to be improved. Fair and rational local legislative project approval procedures should include different procedural stages like the collection of legislative proposals, the preliminary review and collation of legislative proposals, the drafting, review and publication of the draft legislative proposals, and the adoption, publication and adjustment of the local legislative project. Each specific procedure stage needs to be finely constructed.
