濕地保護地方立法若干重點問題探析

濕地保護作為當前我國生態文明建設工作中的重點和熱點，正迎來空前的關注和新的歷史性發展機遇。目前國家層面的濕地保護立法進展遲緩，但濕地保護地方立法具有相當的規模，是推進我國濕地保護的重要力量。從整體上看，濕地保護地方立法中普遍存在的重點問題包括：濕地管理體制，濕地保護的綜合協調機制，濕地保護規劃制度，濕地保護資金保障與生態補償制度，濕地公園的建設與管理，濕地生態用水保障制度。各地的濕地保護立法表現出一定的差異性和特色性，但也存在著可操作性不足、法律效力較低等缺陷，需要及時予以彌補和完善。

As a key point of China's ecological civilization construction, wetland protection legislation meets new historic opportunity of development. At present the progress China's Central Legislation on wetland protection is slow, but large scale in local legislation, the latter is important power to boost wetland protection. Common problems in wetland protection local legislation include management mechanism, coordination system, planning regulation, fund guarantee, ecological compensation, wetland park construction and management, ecological water conservation system. Differences and characteristics exist in wetland protection local legislation, but also have problems of operability shortage and low legal hierarchy, which need timely improvement.
