Local Legislation: Internal Requirement of Compulsory Education Under the Rule of Law

作為義務教育公平的制度載體，地方立法應對就近入學與在家上學、學位矛盾與學校選擇、優化公辦與促進民辦等問題做出回應。同時，要突出地方國家權力機關的立法主體地位，明確地方性法規的權利保障重點，細化義務教育權利的救濟機制。作為義務教育權貴的制度規範，地方政府規章應具有明確的效力邊界，旨在規範義務教育的運行程序、細化政府的義務教育管理職責。

As a system which aims for fair education, compulsory education should respond to following issues: enrollment at nearest schools and home schooling, school places conflicts and school choices, optimization of public schools and promotion of private schools. Local regulations should make clear key points of relevant rights protection, and refine the relief mechanism of compulsory education rights. In respect of the authority and responsibilities regarding compulsory education, the local government rules should clearly define the boundaries of authorities, and set rules for relevant procedures of compulsory education and refine the government administrative responsibilities.
