新《立法法》實施背景下地方立法存在的問題及建議

Problems and Suggestions of Local Legislation with the Enforcement of New Legislation Law in China

我國地方立法實踐中不同程度地存在立法權能受限、越權立法、重複立法、地方部門利益法制化的問題。新《立法法》的實施，在為地方立法克服上述問題帶來可能的同時，也使其面臨新的挑戰。在對新《立法法》的亮點與不足進行評判的基礎上，得出地方立法出現問題的根源在於沒有理順中央與地方立法權之間、地方立法權主體與社會公眾之間、不同地方立法權之間的關係。為了真正解決上述問題，需要以維護法制統一、構建公眾立法參與體系、完善地方立法協作機制為重點，保障新時期地方立法工作的順利進行。

In China's local legislation practices there are problems of limited legislative power, overstepping legislation, repeated legislation and department's interests legalizing. The enforcement of new Legislation Law brings both opportunities and challenges to China's local legislation practice. Based on the highlights and shortcomings of new Legislation Law, it can be concluded that problems of local legislative power lies in the inappropriate relationship between central and local Legislative powers, local legislative bodies and social public, different local legislative subjects. In order to overcome these difficulties, maintaining legislative unification, the mechanisms of public participation and local legislative cooperation should be constructed.
