On the Scientificity and the Subjective Choice of Legislation

立法的科學性在於符合實際與規律。立法受到以下規律的制約：人類作為自然部分的自然規律，社會發展的基本規律，特殊社會的具體規律，社會事件的因果律，法律體系構成的規律。規律的制約並不意味人們在立法中沒有主觀選擇的可能。社會規律發揮作用是在複雜的條件下發生的，人們的主觀選擇就是其中一個條件。對於不同的規律制約，立法主觀選擇的內容和空間各不相同。科學立法與民主立法在性質上並無關聯，科學在性質上與真、與正確關聯，民主則與立法的正當性關聯。但是，現代立法需要科學與民主的結合。

The Scientificity of legislation means the legislation should conform to the reality and objective law. Legislation is restricted by the following objective laws: the natural law that human beings is a part of nature, the basic law of social development, the specific law of special society, the law of cause and effect in social events, and the logic rule in legal system. The restrictions of laws does not mean that people cannot take subjective choice in legislation. Social laws take effect under the complex conditions in which people 's subjective choice is one element. Under the restriction of different laws, there is different content and space for subjective choice of legislation. There is no relationship in nature between scientific legislation and democratic legislation. The scientificity is associated with true and correct in nature, while the democracy is associated with the legitimacy of legislation. However, the modern legislation needs the combination of scientificity and democracy.
