認真對待地方法治──以地方立法在國家法治建設中的功能定位為視角

Take the Rule-of-law at Local Level Seriously － In the Perspective of the Function of Local Legislation in State-Building

任何一個現代國家的法治建設，在某種意義上都是一般性、宏觀性的國家法治與具體性、微觀性的地方法治相結合的產物。而法治的具體性、微觀性主要是由法治的地方性來體現。作為世界上最大的單一制國家，中國的中央與地方在國家法治建設中有著不同的職能定位與各自優勢。中國的法治發展必然充滿著中央與地方的博弈與合作，面臨統一、宏大的“國家法治＂與分散、具體的“地方法治＂之間的緊張關係。中國特色社會主義法律體系建設，應在全國性、統一性與地方性、多樣性之間保持一種必要的張力，在“自上而下＂的中央立法與“自下而上＂的地方立法之間尋找某種契合。

Rule-of-law at State level is always integrated with the rule-of-law at local level during the process of a modern state building. The special and concrete details of a modern state administration are generally represented by the rule-of-law at local level. As the largest unitary and centralized state, central and local government of China play different functions and influence in the development of rule-of-law. It will be full of great divergence and tension between the central in macroscopic sense and the local in microcosmic sense. We should make great efforts to keep the balance between the nationality and locality, unity and diversity. Both the central legislation and the local legislation should accomplish a long-term conformation and coordination in pushing forward the modern rule-of-law in China.
