論基隆市之法律定位及未來發展

A study on the Legal Status of Keelung City and it's Future Development

行政區劃必須基於國家整體發展之需要，作長遠之規劃。行政區劃更必須本於地方自洎之精神，使各地方自治團體能發揮自治之功能。但臺灣從2007年地方制度法修正公布起，以至於 2014年12月25日桃園市的「升格」為六都，這一波的行政區劃，是否能達成此一目標，著實令人懷疑。本文擬從地方自治行政之角度出發，並以基隆市為例，探討行政區劃之相關問題。在行文架構上，本文擬先闡明自治行政之功能與地方自治之意義；其次論述地方自治團體之概念、種類、法律地位及權利能力等問題；進而探討基隆市現行法律地位，最後分析基隆市之未來發展可能，並提出結論與建議。面對時代與環境的變遷，吾人應如何在兼顧文化、社會、經濟及區域發展之完整性下，謀求基隆市之最佳發展？本文預擬了維持現狀、併入新北市、併人大台北市（北北基）、加人台北都、或者合併鄰近六鄉鎮（「大基隆市」）等五種方案，並設定基隆市之主體性、地方自治之功能、居民之地方認同感、組織變革、行政區劃之政策規劃、以及法律依據等六個指標，進而依此六大指標分別分析其利弊得失，而後提出本文之建議，期能有助於釐清基隆市定位與未來發展方向。

Municipal reform must be based on the needs of the development of the country, makng long-term planning. Furthermore, municipal reform must represent the spirits of local self-government, let the local self-governing bodies giving full function of autonomy. But it is doubtful whether the municipal reform in Taiwan from 2007 till 2015 can reach the goal. This article, taking Keelung as example, explores the related problems of municipal reform form the perspective of local self-government. In following will discussion on the functions and significance of local self-government; the concept, types and legal status of local self-governing bodies; the legal status and further development of Keglung City; and finally the conclusion and suggestion.
