Dialectical Materialism Analysis of Intellectual Property System

從辯證唯物主義的視角提出了知識產權制度所包含的根本矛盾，分析了我國知識產權制度已經具備變革的外部條件。對於知識產權制度未來的發展，從一定時期看，其私人性因素無論在程度上還是在範圍上都會加強，但從更長的時間跨度看，知識產權制度更需要解決的是創新成果被資本和少數人佔有與人民群眾需要更好享受創新成果之間的矛盾。隨著社會不斷發展，人的素質和物質財富達到一定水準後，人的自由全面發展必然要求將人的智力勞動和人本身在一個新的高度重新作為一個整體，而到那時，作為將人的智力勞動成果和人本身進行分離的知識產權制度也就失去了存在的根基。

Address the basic contradiction contained in the intellectual property system based on a view of dialectical materialism, and analyzes the existed outside reform condition of China's intellectual property system. For the future development of intellectual property system, in a relatively period of time, its private character will be strengthened, however, in a view of a much bigger time span, the more important contradiction of the intellectual property system to be resolved, is the conflict between the innovation fruits being processed by the capital/the few specific people and the innovation fruits being utilized by the public people. As the development of the society, human diathesis and material fortune accumulate continuously, then the need of human's free and comprehensive development will have to combine human intellectual labor and human being together as an integrated one from a new level. By that time, the intellectual property system, which departs human intellectual labor from human being, will lose its foundation of existence.
