Industrial Structure of Chinese Medical Industry and Intellectual Property Protection

在西方，知識產權對醫藥企業至關重要，醫藥企業一向是加強知識產權保護的主要推動者，同時亦是專利訴訟的常客。但中國醫藥企業對知識產權的重視程度及其知識產權保護行為卻與西方醫藥企業相距甚大，這與中國醫藥產業的特定產業結構與政策因素相關。我國在制定知識產權相關政策的同時，不應忽略使其實際發揮作用的產業環境與土壤；若想提高社會與企業的知識產權保護意識，也必須要考慮到具體產業結構的影響和相關政策的配套調整。

In the West, medcial firms are always the most active promoters of stronger Intellectual Property protections, and are also active litigants. But in China, the case is quite different, either in the importance of Intellectual Property for firms, or in firms' protection behaviors. The explaination for this has to do with the specific industrial structure of Chinese medical industry, as well as the policy background. When Intellectual Property policies are made, the exact industrial environment where it will take effect should not be neglected; if we want to increase the society's awareness of Intellectual Property Protections, we also have to consider these factors and make related adjustments.
