Being a kind o£ stereoscopic thinking, the Judicial Logic concept constructs a structure of criminal court; in contrast the Dualism cannot do anything. According to the Judicial Logic, the criminal norms concept takes on a four-dimensional structure. In order to overcome the Dualism, we should advocate a comprehensive norms concept comprising principles-rules-standards. Based on the Dualism and Doctrine of Rules Only, the traditional criminal law completely ignores the bystanders in the court, as well as the nature and content of conduct norms. Moreover, there is little cognition about its individualism presentation mode in the traditional criminal law. In terms of the Judicial Logic, it is necessary to distinguish the prosecution norms and defense norms. Only in this frame can the legal interest and norms, constitutive requirements and conviction plots be understood. Against a background of conduct norms and above-mentioned distinction, the adjudication norms will possess a neutral feature and a discretional feature. In the process of studying criminal law, judges cannot be deemed as non-individual automatic vending machines. |
