Legal Study on the Electronic Contract in Internet Finance

互聯網金融是互聯網技術與金融交易相結合的一種嶄新業態，2015年7月18日頒布的《關於促進互聯網金融健康發展的指導意見》中將其定義為“傳統金融機構與互聯網企業利用互聯網技術和信息通信技術實現資金融通、支付、投資和信息中介服務的新型金融業務模式”。隨著互聯網金融行業的興起，金融交易的電子化、網絡化，電子合同日益廣泛的應用，必然會帶來新的法律問題。電子合同與傳統合同相比，具有相同的合同要素，但在合同訂立、生效、履行、違約救濟等各個環節，又表現出區別於傳統合同的獨有特性。

Internet Finance is a new form of combination of Internet technologies and financial transactions. The “Guiding Opinions on Promoting the Healthy Development of Internet Finance” promulgated on July 18, 2015, defines Internet Finance as “a new financial business model in which traditional financial institutions and internet companies provide financing, payment, investment, and information intermediary services by using internet technologies and information and communication technologies”. With the rise of the Internet Finance Industry, the electronization and networking of financial transactions, the electronic contract is becoming widely used, which would bring new legal problems inevitably. Compared with the traditional contract, the electronic contract has the same contract elements. But in the stage of conclusion, effectiveness, performance and remedies, the electronic contract is evidently different from the traditional contract.
