工業4.0背景下德國應對3D打印技術的法政策學分析－－兼論我國對3D打印技術的法政策路徑選擇

German Law and Policy Analysis of 3D Printing in the Background of Industrial 4.0：Discussion of Law and Policy Dealing with 3D Printing in China

3D打印技術作為工業4.0中實現“智能生產”和“智能工廠”的方式，是促進我國制造業轉型的重要路徑。通過對德國政府應對3D打印技術發展所制訂的科技政策和法律政策的分析，欲促進我國3D打印技術快速發展，提升我國3D打印產業的國際競爭力，首先，應通過制定和完善與3D打印有關的科技政策，引導科研資源和資本向3D打印產業分流；其次，應通過對現行相關法律的解釋、歸納和演繹，尋求應對3D打印技術發展的法律適用的空間；此外，在政策的制定與法律適用的過程中，需要選擇符合我國國情的3D打印技術保護標準和創新發展之路徑。

In the background of industrial 4.0, Germany developed the technology and legal policy. After Analysis these Experience, this paper suggest, in order to speed the development of China into the 3D printing technology, should ifrstly through the 3D printing policy, guide research resources and capital to the 3D printing industry; Secondly, we should solve the problems posed by 3D printing based on interpretation of the law. At the same time, we also need to select the 3D printing technology protection standards and innovative development path in line with China's national conditions.
