信托基金模式在生態園行政管理中的引入－－美國舊金山普雷西迪奧信托基金模式及啟迪

Management of Ecological Park under Trust Fund: U.S. Presidio of San Francisco Trust and Its Implication

目前，中國的生態園治理模式採用單一的行政管理模式，由於環境保護讓位於經濟利益、問責制度不完善等問題，我國生態園管理效果一直不明顯。借鑒國外成熟經驗—美國運營良好的舊金山普雷西迪奧公園的信托基金管理模式，該模式是兼具公法行政力和私法經營權的混合管理模式，能夠調動市場配置資源的作用，有效配置資源的同時也滿足公共需求，在經濟利益與社會公共利益之間尋求到平衡，解決行政管理僵化，成本高昂的問題，可資借鑒。

At present, governments regulate all ecological parks in China. Since economic interests priors to Environmental protection, systematic accountability is not established etc., administration model of ecological park does not bring good results. Compared with mixed management model-U.S. Presidio of San Francisco Trust, which runs business of Presidio Park in San Francisco under trust fund not government. This business model which can perfectly combine government regulation power and private operation rights, is able to allocate market resources efficiently to meet public needs, get the balance between economic interests and public interests, make the management more flexibly, cut the cost obviously. Hence, we can use the most valuable and suitable points to manage ecological park in China.
