危害食品安全犯罪之罪名體系考

An Analysis of Charges on Food Safety Crimes

危害食品安全的行為不僅包括生產、銷售問題食品的行為，而且還包括非法生產、銷售違禁原料的行為、假冒注冊商標的行為、非法廣告的行為以及相關監管主體的瀆職行為。針對這些行為，我國《刑法》規定了相應的罪名，形成了危害食品安全犯罪的罪名體系。但是，學界目前對這一體系的研究還不夠深入。有鑒於此，有必要全面梳理我國《刑法》中與危害食品犯罪相關的罪名，分析這些罪名之間的關係，以期有助於司法實踐中對危害食品安全犯罪之罪名體系的理解與適用。

The behaviors endangering food safety include producing and selling poor quality food, producing and selling prohibited raw materials, counterfeiting registered trademarks, false advertising, and regulatory malfeasance. In response to these behaviors, Criminal Law in China has developed the corresponding charges. However, the relation among these charges has not been studied comprehensively till now. Therefore, it is necessary to generally clarify and analyze all the charges related to food safety crimes under the Criminal Law in China, to better comprehend and apply the system of charges for food safety crimes in legal practice
