中國農村的分家規範、家產分割與國家法－－從一份分書看農村分家問題

本文從一份當代分書展開，依據分書的內容剖析了分家所包含的各種規則和原則；並通過家產分割與法律規定的共有財產分割、贈與、繼承等制度的比較，分析了家產分割的法律性質。筆者的意圖在於闡明：當今中國社會，還存在著一些像分家習慣一樣的“隱形制度”，因此改進我們的立法和司法工作或許還需要進行一些民事習慣調查的工作。

Based on a contract of family division, the paper analyzes an old custom in rural China-family division, which includes the division rules and principles. The paper tries to discern the legal nature of the family division by comparing it with the legal principles of property division, donation and inheritance. As a conclusion, the paper emphasizes that some “non-obvious institutions” such as familydivision custom still rule China society. Therefore, investigations of civil custom are necessary for the legislation and judiciary practice.
