中國農村贍養習慣與國家法的背離－－以湖北鍾祥石巷村的調查為基礎

本文以調查材料為出發點，詳細描述了湖北省鍾祥市石巷村的贍養習慣。在界定了 “家”和“分家”的概念後，按多子家庭、獨子家庭和無子家庭三種情形，逐一對贍養習慣進行了描述和分析，並試圖從中提煉出一般的贍養規則。最後，本文以基層法院的案卷材料為依據，結合習慣和現行法，對贍養糾紛及其解決方式作了簡要的分析。

Based on an investigation, this paper describes detailedly the maintenance custom in Shixiang village of Zhongxiang city, Hubei Province. Having stated the meaning of “family” and “family division”, the paper describes and analyses the maintenance custom in three kinds of families: multi-son family, singleson family and non-son family, and tries to draw out the general rules of maintenance. Finally, based on the files obtained from the local court, this paper concisely analyses the maintenance disputes and their settlements.
